No, not free as in free beer. Free to sell, buy, breed new strains, etc. An open source-style license would protect the genetics once attached to the license, from ever being stolen by a conglomerate and owned because they found a special pheno and crossed it with their own proprietary genetics.

It's similar to the way things work now except that there's nothing stopping big canna from taking Mephisto genetics, making a cross and preventing companies like Mephisto from subsequently developing strains from that cross because it's now copyrighted.

Yes and no. The initial problem with legalization will be Big Cannabis. Mainly because they will fight tooth and nail to try and limit home grow. Similar to alcohol (re-)legalization. Total legalization should entail home grow. Taxation is not a huge issue if home grow is legal.

Taxation is not a huge issue for the home grower. I guarantee that it is a big freaking issue for the government. Look at how long ti took to get home brewing and how the government will kick your ass nine ways to Sunday if they think that you are distilling anything for any reason.

Big canna can take it. But with the license, it's infected with the rules. So they wouldn't be able to derive their own strains from strains released under the license unless they're willing to forgo suing people who then use those strains to develop new strains.

They'd have to develop new strains from landraces or other strains not released under the license. Things would continue to work as they do right now.

Actually, I believe craft distillation is legal in the US with a license, so long as the resultant product isn't sold. I was really into craft brewing for a while and seem to remember reading something about that.

"Craft" distilling is regulated by the same rules that Suntory Beam or Diageo follows, The BATF and local cops made "house calls" on private individuals who had bought little "essential oils" distilling rigs on line a few years. Scared the shit out of folks. including a realtive of mine who had fortunately left the rig at someone else's house.
